TERMS & CONDITIONS

Fairys Holiday Sdn Bhd was established in October 2010 and is a licensed travel agency under the Malaysian law (License No. 6637).  By purchasing any of Fairys Holiday packages via offline or online, Customers are deemed to have read, understood and accepted the following Terms & Conditions:

Note: All tour rates are meant for Malaysians only and exclude any air fares unless stated otherwise. Rates may change in the event of inconsistent fluctuations in the currency exchange rate and eleventh-hour adjustments or surcharges imposed by accommodation, land, water, and air transport providers, and restaurant, attraction, theme park, sightseeing and tour operators.

1. TERMS OF PAYMENT

1.1 Payment Method

Payment can be made via online banking, cash (CDM machine) or cheque and must be accompanied together with the receipt as proof of payment.

1.2 Deposit & Balance Payment

A non-refundable deposit is required to be made 3 days within confirmation. Failure to comply will result in cancellation of reservation. Please refer to PAYMENT/CANCELLATION TABLE below.

Any payment made beyond the Cancelation Period will not be refunded with the exception of the following (subject to airlines and relevant suppliers’ own terms & conditions):

  • Death
  • Hospitalization and/or Medical Reasons – to be accompanied by a letter from the Hospital (letters from General Practitioners are not acceptable).

If approved, the refund amount will differ from the amount customer have paid.

1.3 Cancellation

Cancellation of booking must made in writing and accompanied with supporting document(s) to avoid any misunderstanding. The date where the notice is received by Fairys Holiday will be the basis for the calculation of penalty charges.

The respective airlines cancellation policy shall apply in additional to the tour cancellation charges as per outlined in the PAYMENT/CANCELLATION TABLE

1.4 Postponement

For any postponement of Tour Package, the customer must cancel the first booking in order to make a new booking. Customer cannot transfer the initial booking deposit to the new booking as it is deem forfeited.

1.5 Cancellation by Fairys Holiday

Fairys Holiday Sdn Bhd reserves the right to cancel the tour due to any act of God, war, strike, riot or official travel restriction notification issued by Wisma Putra which is beyond its control.

Fairys Holiday Sdn Bhd shall recommend alternative tours preferably to the same destination or other tours. Should any passenger decide not to accept the alternative tours, all moneys paid, less the administration fee chargeable, will be refunded to the passenger.

In the event a cancellation by Fairys Holiday Sdn Bhd due to insufficient passengers or inability to secure seats or accommodation, Fairys Holiday Sdn Bhd will refund the amount of money paid, less the administration fee chargeable.

2. REFUNDS

2.1 Refunds

Any payment (deposit or in full) made during travel events such as MATTA Fair and or any roadshows are non-refundable.

No refund will be given for any un-used services during the tour such as accommodation, meals, sightseeing and tours, airfare and other any services included in the tour package.

Where refund is eligible, the processing period will be within 60 days from the date of refund request.

Fairys Holiday also has the right to cancel and refund customers deposit without any reason.

3. TOUR PACKAGE DETAILS

3.1 Tour Package Inclusion

  • return economy class international/domestic flight ticket
  • baggage allowance
  • hotel accommodation based on twin sharing basis (2 person to a room)
  • meals as indicated in the itinerary
  • travel insurance
  • admission fees, unless stated otherwise
  • tipping for guide service, unless stated otherwise
  • travel insurance, unless stated otherwise

3.2 Tour Package exclusion

  • visa fees, if necessary
  • peak season surcharges
  • optional tours
  • excess baggage, laundry services, mini bar and/or other items which are deem personal in nature

4. SPECIFIC REQUEST

4.1 Accommodation

Standard tour package accommodation is based on Twin Sharing (for 2 Adults in a room) unless a request for Single Occupancy is made.

Triple or Quad sharing rooms are offered based on destination and hotel availability.

Child fare applies for those aged between 2-11 years old with the option of Child with bed or Child without bed and will be sharing as a third person in a Twin or Double Room with 2 Adults. The extra bed will be determined by the hotel and is either an extra bed or a roll away.

Most European hotels provide 2 single beds pushed together to make a double bed.

While all room preferences are forwarded to the hotel, room allocation and location will be determined by the hotel.

Fairys Holiday cannot guarantee the actual bedding option and location of the rooms and are subject to hotel policy and availability.

Any last minute changes on room arrangements will not be entertained. Should the customer insist on the change, all additional charges and/or penalties will be borne by the customer and Fairys Holiday shall not be held responsible for any additional costs incurred.

4.2 Flight

Flight timing and schedules are not guaranteed and do not form part of the contract. All flight schedules are subjected to change without prior notice.

Flight seats are especially for group travels are allotted by the respective airlines. Should the customer insist on a specific seat, all additional charges and/or penalties will be borne by the customer and Fairys Holiday shall not be held responsible for any additional costs incurred.

Fairys Holiday cannot guarantee the actual in-flight seating arrangements and is subject to airline policy and seat availability.

5. AIRPORT TAXES & FUEL SURCHARGES

Airport taxes & fuel taxes are subject to change due to international currency fluctuations from time to time. Customers will be informed of any increase in airport & fuel taxes during booking procedure

6. CHANGES IN PUBLISHED RATES

Fairys Holiday reserves the right to correct any pricing or displayed errors and/or commissions, which includes errors and/or commissions from a supplier or hotelier.

In the event of a price error, we will offer the customer a choice of either retaining the current booking at the correct pricing or cancelling the booking or offer a suitable alternative hotel. This will apply to both confirmed and under request bookings.

7. TRAVEL DOCUMENTS

It is the customer’s responsibility to ensure that they have must have a valid International Passport with a minimum 6 months validity from the date of return.

A copy of the main page (biodata) is required to be emailed to Fairys Holiday upon booking confirmation to enable Fairys Holiday to ensure accuracy of information when creating

  • flight reservation
  • issuance of tickets
  • rooming list
  • other related tour documents and arrangements

Customer is responsible to ensure that they are cleared of being blacklisted by the Regulatory Bodies such as LHDN, Banks, Insolvency Department and other bodies which may restrict customer from traveling abroad.

Fairys Holiday will not be responsible for any refund, change or deferment of travel resulting from such restrictions.

8. RESPONSIBILITY AND LIABILITY

All arrangements for the provision of transport, accommodation, sightseeing and other tour or travel services are made by Fairys Holiday through our appointed agents.

We try our best to ensure that the tour itinerary is arranged to keep within the prayer time and halal meals are arranged at local restaurants especially to cater for our Muslim customers.

Fairys Holiday accepts no responsibility for any injuries, damage, accidents, loss, delay, theft, quarantine, custom regulations, strike, acts of God, and/or changes of itinerary, deportation or refusal of entry by immigration.

Customers are responsible for all losses and expense from authorities confiscation resulting from improper travel documents, procession of unlawful items or irregularities.

Proper travel documents are expected of all customers.

Fairys Holiday also reserves the right to request for any individual to withdraw from the tour if it is deemed that his or her behavior or conduct is detrimental to or incompatible with health, safety, interest, harmony and welfare of the other tour participants and the tour group. Under such circumstances, Fairys Holiday shall be under no liability thereafter to any such person.

No Tour Leader or Tour Guides, employees or agents of Fairys Holiday are authorized to commit Fairys Holiday to any liability. Fairys Holiday will not be bound by any statement or representation unless is it in writing and signed by the company management.

Fairys Holiday will not be held responsible for any losses and expense of domestic air ticket, local hotel, transportation to and from the airport, and other personal travel services that is booked by customers due to international flight change or cancellation.

Fairys Holiday reserves the right to revise the tour fare and to determine the date of commencement of such revised tour fares.

All enquiries will be attended to within 24 hours to a maximum of 3 working days. Depending on the nature of your enquiry, please allow up to 30 working days especially in the case of past booking queries for it to be investigated and resolve.

Fairys Holiday reserves the right to change, amend, insert or delete any of the terms and conditions and policies contained within this document, as the case may be, without prior notice.

9. DISCLAIMER

Fairys Holiday does not accept liability for any errors and reserves the right to change the information published at any time and without prior notice.
